Cloudflare offers a globally distributed content delivery network with DNS. This technically routes the transfer of information between your browser and our website through Cloudflare’s network. Content Delivery Network from StackPath

We use a so-called “Content Delivery Network” (CDN), offered by StackPath, LLC, 2021 McKinney Avenue, Suite 1100 Dallas, Texas 75201, USA.

A CDN enables us to deliver some content quickly, especially large media files. This is done via a network of regionally distributed servers that are connected via the internet. The processing of user data is solely for the aforementioned purposes and serves to maintain the security and functionality of the CDN.

The use is based on our legitimate interests, i.e. interest in a secure and efficient provision, analysis and optimisation of our online offer (Art. 6 para. 1 lit. f DSGVO).

Note on data transfer to the USA

Among other things, tools from companies based in the USA are integrated on our website. If these tools are active, your personal data may be transferred to the US servers of the respective companies. We would like to point out that the USA is not a safe third country in the sense of EU data protection law. US companies are obliged to hand over personal data to security authorities without you as a data subject being able to take legal action against this. Newsletter data

Handling of applicant data

We offer you the opportunity to apply to us (e.g. by e-mail, post or via online application form). In the following, we inform you about the scope, purpose and use of your personal data collected as part of the application process. We assure you that the collection, processing and use of your data will be carried out in accordance with applicable data protection law and all other legal provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection

If you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes in the context of job interviews, etc.) to the extent that this is necessary to decide on the establishment of an employment relationship. The legal basis for this is § 26 BDSG-neu under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b DSGVO (general contract initiation) and – if you have given your consent – Art. 6 para. 1 lit. a DSGVO. The consent can be revoked at any time. Your personal data will only be passed on within our company to persons who are involved in processing your application.

If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of § 26 BDSG-neu and Art. 6 para. 1 lit. b DSGVO for the purpose of implementing the employment relationship.

Retention period of the data

If we are unable to make you a job offer, if you reject a job offer or withdraw your application, we reserve the right to retain the data you have provided on the basis of our legitimate interests (Art. 6 para. 1 lit. f DSGVO) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. This storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g. due to an impending or pending legal dispute), the data will only be deleted when the purpose for continued storage no longer applies.

Longer storage may also take place if you have given your consent (Art. 6 para. 1 lit. a DSGVO) or if legal storage obligations prevent deletion.

Admission to the applicant pool

If we do not make you a job offer, it may be possible to include you in our applicant pool. In the event of inclusion, all documents and details from the application will be transferred to the applicant pool in order to contact you in the event of suitable vacancies.

Inclusion in the applicant pool is based exclusively on your express consent (Art. 6 para. 1 lit. a DSGVO). The provision of consent is voluntary and is not related to the current application process. The person concerned can revoke his/her consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, unless there are legal reasons for retention.

The data from the applicant pool will be irrevocably deleted no later than two years after consent has been given.

Processing of personal data within the framework of personnel placement

The core activity of our company is the placement of employees. Applications that we receive for the purpose of placement are used exclusively for this purpose. The processing of personal data is therefore based on your consent pursuant to Art. 6 para. 1 lit. a DSGVO. Your personal data will not be passed on to third parties for purposes other than the placement activity. Disclosure to third parties, such as employers and companies looking for personnel, who have a justified possible interest in hiring or placing you, will only take place in the form of an anonymised candidate profile and only after we have described the position to be filled to you in more detail. Your application documents will only be passed on to third parties on condition that a contractual obligation to maintain data protection has been concluded with the respective business partner. However, we cannot assume any responsibility for the form in which and the purpose for which your personal data is processed and used when it is passed on to third parties.

Applicants have the right to assert their data subject rights at any time, in particular the right to information on their data stored with us, the right to correction, deletion and blocking vis-à-vis ageneo. If you commission us with headhunting, personnel consulting or other recruiting services, we process your personal data for the execution of your order or pre-contractual measures that take place upon your request. The legal basis is Art. 6 para. 1 lit. b DSGVO.

Data processing by social networks

We maintain publicly accessible profiles on social networks. You can find the social networks we use in detail below.
Social networks such as Facebook, Twitter, etc. can usually comprehensively analyse your user behaviour when you visit their website or a website with integrated social media content (e.g. like buttons or advertising banners). By visiting our social media presences, numerous data protection-relevant processing operations are triggered. In detail:
If you are logged into your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. However, your personal data may also be collected under certain circumstances if you are not logged in or do not have an account with the respective social media portal. In this case, this data collection takes place, for example, via cookies that are stored on your end device or by recording your IP address.

Legal basis

Our social media presences are intended to ensure the most comprehensive presence possible on the internet. This is a legitimate interest within the meaning of Art. 6 (1) lit. f DSGVO. Responsible person and assertion of rights

If you visit one of our social media sites (e.g. Facebook), we are jointly responsible with the operator of the social media platform for the data processing operations triggered during this visit. Storage period

The data collected directly by us via the social media presence is deleted from our systems as soon as the purpose for storing it no longer applies, you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies. Stored cookies remain on your end device until you delete them. Mandatory legal provisions – in particular retention periods – remain unaffected.

Categories of recipients of personal data

Within our company, only those employees have access to the data who absolutely need it to perform their tasks (need-to-know principle). Individual processes and services are carried out by carefully selected service providers who are based within the EEA and who comply with data protection regulations. If service providers commissioned by us receive access to personal data when performing your services, order processing agreements have been concluded with them in accordance with Art. 28 (3) DSGVO.

Duration of data storage

The data processed by us is stored for the duration of the existence and processing of the contractual relationship and in compliance with statutory retention periods. These are, in particular, retention obligations under commercial and tax law in accordance with the German Commercial Code (HGB) and the German Fiscal Code (AO). The regular retention and documentation periods are up to ten years. If there is no contractual relationship, we only process the data for as long as the specific purpose requires.

Your data subject rights

As a data subject, you have the following rights with regard to the personal data concerning you:

  • Right to information about the data we process about you.
  • Right to rectification or deletion if incorrect, out of date or unlawfully collected by us.
  • Right to restriction of processing if complete deletion is not possible, e.g. because we have to comply with statutory retention obligations.
  • Right to object to processing where the data processing is based on a balance of interests (the so-called legitimate interest), as described above under “Purpose of the processing”. This is the case if the processing is not necessary, in particular, for the performance of a contract with you.
